1. Contract
These Terms & Conditions (the “Terms”) govern your booking and participation in any activity, tour, or service provided by Waipiʻo Cultural Experience (the “Company”). By placing a booking or participating, you agree to be bound by these Terms.
2. Booking, Payment, and Confirmation
- All prices are shown in USD and are per person unless stated otherwise.
- Bookings are confirmed only upon successful payment and receipt of a confirmation email.
- We reserve the right to refuse or cancel any booking for operational, safety, or compliance reasons.
3. Participant Requirements
- Participants must be physically able to take part in outdoor activities over uneven terrain.
- Parents/guardians must accompany minors and are responsible for their supervision.
- Participants must follow guide instructions and respect cultural protocols and restricted areas.
4. Changes, Weather, and Cancellations
We may modify routes, schedules, or activities due to weather, safety, access, or cultural considerations. See our Cancellation Policy for guest‑initiated cancellations, reschedules, and refunds.
5. Assumption of Risk and Waiver
Participation involves inherent risks typical of outdoor activities. All participants must agree to and sign the Participant Agreement and Liability Waiver during checkout (and on site if requested).
6. Conduct
We may remove any participant for unsafe behavior, intoxication, harassment, or failure to follow instructions. No refunds will be provided in such cases.
7. Privacy
We process personal data in accordance with our Privacy Policy.
8. Intellectual Property
Content on our website and materials provided during activities are owned by the Company and protected by law. You may not reproduce or distribute such content without permission.
9. Liability
To the fullest extent permitted by Hawaiʻi law, the Company’s liability is limited as described in the Waiver and these Terms. In no event shall the Company be liable for indirect, incidental, or consequential damages.
10. Governing Law and Venue
These Terms are governed by the laws of the State of Hawaiʻi. Exclusive venue lies in the state or federal courts of Hawaiʻi County, Hawaiʻi.
11. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
